
We love to ship. But AI changes the game: systems learn, vendors silently swap models, data moves in ways nobody expected. That’s not just a tech risk—it’s contract, compliance, and brand-trust risk. The answer isn’t “move slow.” It’s move smart, then fast.
Below are seven habits I’ve seen work in real teams. Each one includes what to do, what to watch, and a drop-in artifact you can use today.
1) Bring Legal In Early (and With Context)
Do: Book a 30-minute “AI scoping” with Legal before you build the POC. Bring a one-pager: purpose, data in/out, third-party services, where the model runs, and what “good” looks like.
Watch: “We’ll loop Legal later.” Later becomes never—until an RFP or audit blocks you.
Artifact — 1-Pager Skeleton
Use case: [who, what outcome, why AI vs rules]
Data IN: [sources, sensitivity, retention]
Data OUT: [where it lands, who can see it]
Model: [provider/version, can it change? upgrade policy?]
Controls: [authn/authz, redaction, PII handling]

2) Keep a Lightweight Decision Log
Do: Capture early choices (data access, prompts, guardrails) and the “why.” Two minutes per entry saves two weeks during due diligence.
Watch: Memory rot. Three months later nobody remembers why you allowed log ingestion or chose Provider X.

3) Build Systems You Can Explain
Do: Prefer components with stable, pinned model versions, model cards, and change logs. If a vendor can hot-swap the foundation model, insist on notification + rollback.
Watch: “Black-box” SaaS where the provider can change behavior or data flows without notice.

- Model/version pinned or change-notified
- Inference path documented (pre/post-processing)
- Data lineage (where it came from, how it’s transformed)
- Eval suite with thresholds (toxicity, bias, hallucination rate)
- Rollback path if behavior regresses

4) Kill Shadow AI With a Safe Sandbox
Do: Offer a sanctioned playground (approved tools, fake/synthetic data, clear rules). People go rogue when the “good” path doesn’t exist.
Watch: Individual sign-ups that click through data-sharing terms on behalf of your company.
Artifact — 5-Line Guardrail
No customer data in AI tools unless approved.
Use only the sanctioned workspace and providers list.
PII/Secrets must be redacted before prompts/ingestion.
Log prompts & outputs for high-risk use cases.

5) Translate Contracts Into Technical Reality
Do: Sit with Legal on clauses about data ownership, training rights, model drift, export controls, and subprocessors. Map each clause to a control in your architecture.
Watch: “We don’t train on your data” marketing promises that exclude logs/telemetry or “improve service” loopholes.

6) Design for Auditability From Day 1
Do: Assume tomorrow’s regulator asks for who accessed what, when, and why. Log prompts, inputs, outputs, model/version, and user identity. Keep eval results and dataset snapshots.
Watch: Agent chains with unclear identity propagation and silent tool calls.

7) Treat Customer Data Like It’s Not Yours (Because It Isn’t)
Do: Default to no ingestion of private customer data. When you must, minimize, mask, or use synthetic data that’s vetted by Legal and Security.
Watch: “Index everything” toggles in search/assist products. Support logs often contain secrets.

Raw data -> Classify -> Redact/Mask -> Validate -> Embed/Infer
(PII? Secrets?) (hash/email? drop fields?)
Red Flags That Stall AI Projects
- Vendor can change models without notice
- No written policy for prompt/response logging
- “We don’t know” where embeddings live or for how long
- Agents executing tools without enforceable authZ
- No evals or thresholds; success = “it looks good”
- Personal accounts for production workloads
A Tiny, Boring, Powerful Layer: The “AI Controls File”
Put a single ai-controls.md in the repo:
- Model matrix: allowed models, versions, endpoints, fallback/rollback
- Data rules: what may/may not be sent; masking rules; retention
- Logging: what is logged, where it’s stored, rotation
- Change management: how model or prompt changes are reviewed
- Contacts: Legal, Security, Procurement, DPO
This file becomes the anchor for onboarding, audits, and vendor reviews.
TL;DR
You don’t need a 60-page policy to be safe and fast. You need early Legal visibility, a decision log, explainable components, a safe sandbox, contract-to-control mapping, audit-by-design, and strict data hygiene. Do those seven things and you’ll ship AI that your customers, auditors, and future you can trust.
